Conditions of use

The use of the services accessible through the www.intervida.org Website is subject to the following general conditions.

1. General Conditions and Acceptance
These general conditions regulate the use of services FUNDACIÓN INTERVIDA makes freely available to users of the www.intervida.org Website. The use of these Services binds the user to these conditions and implies acceptance of the General Conditions of this version published by FUNDACIÓN INTERVIDA on the Website at the time when the User accesses the same.
2. Objective
The present General Conditions regulate all Services offered by FUNDACIÓN INTERVIDA through this Website, including comments make about news or articles, Forums, blogs, etc., as well as the use of the same on the part of the Users. However, FUNDACIÓN INTERVIDA reserves the right to modify the presentation, configuration and content of the Services, as well as the conditions required for their use.
3. Conditions of Access and Use of Services
3.1. Free access and use of the Services.
The Services provided by FUNDACIÓN INTERVIDA are free; however, the use of the same implies the acceptance of the current General Conditions.
3.2. Username
To use the Services provided on this Website, the User should identify himself with his username, with or without last names, which will permit him to comment on the news, articles, comments, etc., or to access the rest of the Services. The User cannot select as username offensive or harmful words or expressions, words which coincide with brands, commercial names, established labels, names of other people, social denominations, advertising slogans, names or pseudonyms of figures of public relevance or fame whose use is unauthorized and, in general, which violate the law or moral sensibility and generally accepted good practices. The User should provide FUNDACIÓN INTERVIDA with a valid electronic mail address. If the User does not complete the form with both a valid username and electronic mail address, he will not be able to use the Services of this Website, since these are required fields. Acceptance of the username occurs automatically and the only criteria used is that this username is not already assigned to another user. However, FUNDACIÓN INTERVIDA reserves the right to eliminate those usernames which violate the criteria previously mentioned and when it considers this to be opportune.
Obligation to make correct use of the Services.
The User agrees to use the Services provided by FUNDACIÖN INTERVIDA in accordance with the law, with the present General Conditions, as well as the generally accepted Web practices. The User is obliged to abstain from using these Services for illicit ends or to effects contrary to those established in the General Conditions. The User agrees that in the services for commenting on news, blogs, as well as any other service which permits the publication of the opinions of the Users, we will not accept announcements, electronic mail chain messages or any other content which does not consist in offering an opinion about the articles or news. By using the Services, the User manifests his conformity with these General Conditions, agreeing to not use these to send messages which defame or insult, or which contain false information, or are inappropriate, abusive, damaging, pornographic, threatening, which in any way violate the Law, and/or any other content of any type which may offend or damage the image, intimacy and/or honor of INTERVIDA, its sponsors, collaborators, employees, sponsored children or third parties. In particular, and for indicative purposes and by no means exhaustive, the User agrees not to capture data for publicity aims, not to send any kind of online publicity, and not to transmit, disseminate, or make available to third parties the Services provided by FUNDACIÓN INTERVIDA, information, messages, graphics, sound or images archives, photos, recordings, software and in general any other class of material, data or content which :
  • (a) in any way violates, underestimates or infringes upon the fundamental rights and public freedoms recognized constitutionally or in international treaties and in all other legal ordinances;
  • (b) induces, incites or promotes criminal, denigrating, defamatory or violent acts;
  • (c) induces, incites or promotes discriminatory actions, attitudes or ideas based on sex, race, religion, beliefs or age;
  • (d) incorporates criminal, violent or degrading messages;
  • (e) induces or incites people to get involved in practices which are dangerous, risky or harmful to one’s health and psychic balance;
  • ((f) are false, ambiguous, inexact, exaggerated or extemporaneous, in such a way that they could induce an error with regards to its object or the intentions or purposes of the communicator;
  • (g) are protected by any rights regarding intellectual or industrial property belonging to third parties, without the User having previously obtained the necessary authorization from its title holders to be able to use this to the effects or intended effects;
  • (h) violate the business secrets of third parties;
  • (i) are contrary to the right to honor and the personal or familiar intimacy, or a person’s image;
  • (j) infringe upon the norm on the confidentiality of communications;
  • (k) provoke due to its characteristics (such as format, extension, etc.) difficulties in the normal functioning of the Services;
  • (l) are limited to the comments and contributions which are related with the published article;
  • (m) Use the correct and respectful tone. Inappropriate comments or comments made with an offensive tone will be edited or eliminated.
3.4. Responsibility for damages.
The User will answer for the incompliance of any of the obligations to which he is bound by virtue of the present General Conditions or by law in relation with the use of these Services.
4. Personal Information.
As indicated above, prior to using the Services the User should provide FUNDACIÓN INTERVIDA with certain personal information by filling out a brief form consisting of three fields (Name, Surname and e-mail). The User guarantees the veracity, exactness, validity and authenticity of the Personal Information provided. Under no circumstance will FUNDACIÓN INTERVIDA sell or use this Personal Information for its exploitation or commercial use.
5. Use of these Services is the Exclusive Responsibility of the User.
The User is awareness of and voluntarily accepts that he or she is solely responsible for the use of the Services. Taking into account the character of these Services, the content of the message published through the same only express the opinion of the author. FUNDACIÓN INTERVIDA does not guarantee the exactitude, integrity or utility of any message and, as such, is under no circumstances responsible for the content of the same.
6. Exclusion of Guarantees and Exoneration of Responsibility
6.1. Availability, continuity, utility and fallibility .
FUNDACIÓN INTERVIDA does not guarantee the availability or continuity of the functioning of the Services. When reasonably possible, FUNDACIÓN INTERVIDA will previously advise as to interruptions in the functioning of the Services. Neither does FUNDACIÓN INTERVIDA guarantee the utility of the Services for any activity in particular, nor its infallibility. FUNDACIÓN INTERVIDA does not assume responsibility for the damages of any nature which may be caused due to the lack of availability of continuity of the Services, suspensions in service and, in particular, while no exclusive mode is provided, the temporary limitations in access to the various Webpage services for comments. FUNDACIÓN INTERVIDA may, at any time, temporarily or definitively suspend any Service.
6.2. Exclusion of guarantees and exoneration of responsibility for the use of the Services by Users.
FUNDACIÓN INTERVIDA has no obligation to control the Users’ use of these Services. In particular, FUNDACIÓN INTERVIDA does not guarantee what the Users use the Services in accordance with these General Conditions, or that they do so in a diligent way. Nor does FUNDACIÓN INTERVIDA have the obligation to verify the identity of the Users or the veracity, validity, exhaustiveness, and/or authenticity of the information the Users provide about themselves to other Users. In any case, it will conserve the data and information mandated by current legislation.
7. Limitation in the Use of Services.
FUNDACIÓN INTERVIDA reserves the right to deny use of the Services and remove the information, data and content disseminated or made available to third parties through any of these Services at any time and without being required to previously advise those Users which do not comply with these General Conditions. FUNDACIÓN INTERVIDA can eliminate those messages which is considers inappropriate, out of context or which do not follow the debate.
8. FUNDACIÓN INTERVIDA license.
The User declares to have read the Conditions which appear on http://www.intervida.org and accepts that the comments and opinions made through any of the Services and distributed by FUNDACIÓN INTERVIDA are governed by the same.
